By accessing or using Messages from Past ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use the Service.
2. Description of Service
Messages from Past is an AI-powered memorial service that allows users to upload photographs of deceased loved ones and receive AI-generated video messages. The Service is intended solely for personal, non-commercial use as a memorial and grief support tool.
3. User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information and promptly update it if it changes. You are responsible for all activity under your account.
4. Credits and Payments
The Service operates on a credit-based system. Credits are purchased through Razorpay and are non-transferable. Credits are deducted only upon successful video generation. Unused credits do not expire but are non-refundable except as described in our Refund Policy. We reserve the right to modify credit pricing at any time.
5. User Content and Photographs
You represent and warrant that you own or have the right to use all photographs and content you upload. By uploading content, you grant us a limited licence to process and store your content solely to provide the Service. We do not claim ownership of your content. You must not upload photographs of living persons without their consent, or content that is illegal, offensive, or violates the rights of others.
6. AI-Generated Content
The videos generated by the Service are created by artificial intelligence. They are artistic representations and not actual recordings of deceased persons. We make no representation that the output will match your expectations. You use the generated content at your own discretion and emotional risk. We are not liable for any emotional distress arising from the use of the Service.
7. Prohibited Conduct
You may not use the Service to: upload content depicting non-consenting living individuals; create content for commercial exploitation; circumvent credit deductions or payment systems; share, sell or distribute generated videos commercially; abuse, harass, or exploit the Service in any manner that degrades its availability for other users.
8. Termination
We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms, abuse the Service, or engage in fraudulent activity. Terminated accounts forfeit any remaining credits without refund.
9. Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Messages from Past and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
10. Governing Law
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
